Introduction.
This page contains the Terms and Conditions
governing your use of the MANPOWER PHILIPPINES
Web Site and its services. Please read this
page carefully. The following Terms and
Conditions form a binding Agreement between
you and MANPOWER PHILIPPINES. Your use of
the MANPOWER PHILIPPINES Web Site indicates
your acceptance of these Terms and Conditions.
If you do not accept these Terms and Conditions,
you may not use the MANPOWER PHILIPPINES
Web Site.
The
use of MANPOWER PHILIPPINES and its services
is a privilege. MANPOWER PHILIPPINES reserves
the right to suspend that privilege on an
individual basis for any reason at any time,
in its sole discretion. Questions concerning
the use of the MANPOWER PHILIPPINES Web
Site and its services should be directed
to info@manpower-philippines.com.ph
This
Web Site (and any other site accessed through
this site) and the services provided therein
are only available to Recruitment Agencies
(“Agencies”) posting or promoting
their job vacancies or users searching employment
("Job hunters") or users searching
employees or advertisers ("Employers")
and are subject to the Terms and Conditions,
which are set out below. If you do not accept
the Terms and Conditions, please do not
use this Web Site. Upon your acceptance
of the Terms and Conditions, they are binding
upon you. MANPOWER PHILIPPINES ("the
Portal Subsidiary") may revise the
Terms and Conditions from time immediately
upon notice to you. Your access to the Portal
Subsidiary's Web Site and its services will
be terminated upon your notice to the Portal
Subsidiary that any change is unacceptable
otherwise your continued use will constitute
your acceptance of all changes and they
will be binding upon you. |

| Specific
Uses – Recruitment Agencies
Recruitment
Agencies agree that upon their subscription to
the Portal Subsidiary’s services or upon
their payment for the said services, they will
be entitled to use the Portal Subsidiary’s
Web Site to post their job vacancies and/or create
their own web page or store up to fifty (50) job
hunters that had submitted their resumes on the
database allotted for each Agency on the Portal
Subsidiary's Web Site for a predetermined period
following agreement of the predetermined service.
Recruitment
Agencies will also be entitled to access the said
allotted Applicant Database but agree that all
information obtained will only be used for the
purpose of obtaining potential applicants. Recruitment
Agencies will be solely responsible for the contents
and materials contained in their job postings
and/or web page. The Portal Subsidiary reserves
the right to edit any job posting or web page
as it sees fit. The Portal Subsidiary reserves
the right to change the Monthly Subscription Fee
or institute new charges or fees, as it deems
appropriate. In the event that any Recruitment
Agencies should fail to pay the Monthly Subscription
Fee or any other fees or changes due to the Portal
Subsidiary, the Portal Subsidiary reserves the
right to suspend or terminate the Recruitment
Agencies’ web page or job posting, without
prejudice to all other rights and remedies.
Specific
Uses - Job hunters
Job
hunters agree that they will only use the Portal
Subsidiary's Web Sites (and any other sites accessed
through them) for lawful purposes and to seek
employment. Job hunters may send their resume
directly to any Recruitment Agencies who posted
job vacancies on or through the Portal Subsidiary
Web Sites. Alternatively, the Job hunter may send
his/her resume to the Portal Subsidiary through
the Portal Subsidiary's Web Sites in reply to
any job postings. In such event, the Job hunter's
resume will also remain active on the Portal Subsidiary's
Web Sites for a predetermined period and, unless
the Job hunter chooses to delete it, it will thereafter
be stored in the Portal Subsidiary's Database
at the Job hunter's own risk. The Portal Subsidiary
also reserves the right to edit any Job hunter's
resume as it sees fit. Job hunters acknowledge
and agree to the Portal Subsidiary's practice
of charging Recruitment Agencies a fee for access
to the Portal Subsidiary's web sites, Database
and to the Job hunter's resumes and details. The
Job hunters also recognizes that he has no claims
to any such fees received by the Portal Subsidiary.
The Portal Subsidiary will send the Job hunter's
personal data to potential Recruitment Agencies,
which the job hunter has applied for a job to.
The Job hunters personal details will be available
to Recruitment Agencies searching the Portal Subsidiary’s
resume database only if the job hunter has permitted
the release of this information in the Job hunters
privacy settings.
However
Job hunters do agree that the Portal Subsidiary
and its associated companies may use the Job hunter's
personal data for marketing purposes. Furthermore,
the Portal Subsidiary will not be responsible
or held liable in any way if any Recruitment Agency
in the country should use the Job hunter's personal
data for any other use other than for obtaining
potential employees. Job hunters accept that personal
data given to Recruitment Agencies or other users
are given entirely at their own risk.
Specific
Uses - Employers
Employers
agree that they will only use the Portal Subsidiary's
Web Sites (and any other sites accessed through
them) for lawful purposes and to seek Recruitment
Agencies. Employers may browse the Agencies Directory,
select a potential Recruitment Agency, check their
particular profile, and contact the Agency. The
Portal Subsidiary’s Web Site will not the
Employers to have an access to browse the Applicant
Database of each Agency. Only the Agencies can
permit the Employers with the said action

Prohibited Uses – Recruitment
Agencies, Job hunters and Employers |
| Recruitment
Agencies, Job hunters and Employers agree not
to use any of the Portal Subsidiary's Web Sites
for any of the following purposes, which are expressly
prohibited:
- Job
hunters all not post any non-resume information
and/or incomplete, false or inaccurate resume
information, which is not their own accurate
resume.

Job hunters shall not respond to any employment
opportunity for any reason other than to apply
for the job advertised and Recruitment Agencies
shall not respond to any Jobseeker other than
in connection with their application for a job.
Communications soliciting business for any reason
is prohibited.

All users shall not print, download, duplicate
or otherwise copy or use of any personally identifiable
information about other users. All unsolicited
communications of any type to users is strictly
prohibited.

All users shall not delete or revise any material
posted by any other person or entity.

All users are prohibited from violating or attempting
to violate the security of the Portal Subsidiary's
Web Sites (or any other sites accessed through
the Portal Subsidiary 's Web Sites) including,
without limitation, accessing data not intended
for them or logging into a server or account
which they are not authorized to access, attempting
to probe, scan or test the vulnerability of
a system or network or attempting to breach
security or authentication measures without
proper authorization, attempting to interfere
with service to any user, host or network or
sending unsolicited e-mail, including promotions
and/or advertising of products or services,
violations of system or network security may
result in civil or criminal liability.

All users will not use the Portal Subsidiary's
Web Sites in order to transmit, distribute or
store material in violation of any applicable
law or regulation, or in any manner that will
infringe the copyright, trademark, trade secrets
or other intellectual property rights of others
or violate the privacy or publicity or other
personal rights of others, or that is libelous,
obscene, threatening, abusive or hateful.

COPYRIGHT, TRADEMARKS, ETC. |
| The
graphics, images, articles, contents and HTML
on all the MANPOWER PHILIPPINES’ Web Site
are the intellectual property of the I-ACTIVE
PLUS Technologies Inc., as the creator and developer
of MANPOWER PHILIPPINES and are protected by copyright
and trademark laws and may not be downloaded or
otherwise duplicated without the express written
permission of the MANPOWER PHILIPPINES. Re-use
of any of the foregoing is strictly prohibited
and the MANPOWER PHILIPPINES reserves all rights.
Responsibility
The
Portal Subsidiary may not monitor its Web Site
at all times but reserves the right to do so.
The Portal Subsidiary takes no responsibility
whatsoever for any material input by any user
or others and not posted by the Portal Subsidiary.
All users acknowledge and agree that they are
solely responsible for the form, content and accuracy
of any resume, advertisement, web page or material
contained therein placed by them. The Portal Subsidiary
is not responsible for the content of any other
web sites linked to the Portal Subsidiary's Web
Sites; links are provided as Internet navigation
tools only. The Portal Subsidiary does not warrant
that any resume, advertisement or web page will
be viewed by any specific number of users or that
it will be viewed by any specific user. The Portal
Subsidiary is not in anyway to be considered to
be an agent with respect to any users use of the
Portal Subsidiary 's Web Sites and the Portal
Subsidiary will not be responsible in any way
for any decision, for whatever reason made, made
by any party seeking or posting jobs on the Portal
Subsidiary's Web Sites. THE PORTAL SUBSIDIARY
DOES NOT WARRANT THAT ITS WEB SITE WILL OPERATE
ERROR-FREE OR THAT ITS WEB SITES AND ITS SERVER
ARE FREE OF VIRUSES OR OTHER HARMFUL MECHANISMS.
IF USE OF THE WEB SITE OR THEIR CONTENTS RESULT
IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT
OR DATA, BY ANY USER, THE PORTAL SUBSIDIARY WILL
NOT RESPONSIBLE FOR THOSE COSTS. THE PORTAL SUBSIDIARY'S
WEB SITES AND THEIR CONTENTS ARE PROVIDED ON AN
"AS IS" BASIS WITHOUT ANY WARRANTIES
OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY
LAW, THE PORTAL SUBSIDIARY DISCLAIMS ALL WARRANTIES,
INCLUDING WITHOUGH PREJUDICE TO THE FOREGOING,
ANY IN RESPECT OF MERCHANTABILITY, NON-INFERINGEMENT
OF THIRD PARTY RIGHTS, FITNESS FOR PARTICULAR
PURPOSE, OR ABOUT THE ACCURACY, RELIABILITY COMPLETENESS
OR TIMELINESS OF THE CONTENTS, SERVICES, SOFTWARE,
TEXT, GRAPHICS AND LINKS OF THE PORTAL SUBSIDIARY'S
WEB SITE.
Own
Risk
All
USERS USE THE PORTAL SUBSIDIARY'S WEB SITE AND
ANY OTHER WEB SITE ACCESSED THROUGH IT, AT ENTIRELY
THEIR OWN RISK. ALL users are responsible for
their own communications and are responsible for
the consequences of their posting. The Company
does not represent or guarantee the truthfulness,
accuracy or reliability of any of the communications
posted by other users or endorse any opinions
expressed by users. Any reliance by users on material
posted by other users will be at their own risk.
The Portal Subsidiary reserves the right to expel
any user and prevent their further access to the
Portal Subsidiary's Web Sites, at any time for
breaching this Agreement or violating the law
and also reserves the right to remove any material
which is abusive, illegal or disruptive.
Links
to Other Sites
The
Portal Subsidiary's Web Site may contain links
to third party Web Sites. These are provided solely
as a convenience to you and not in any way as
an endorsement by the Portal Subsidiary of the
contents on such third-party Web Sites. If any
user accesses any linked third party Web Sites,
they do so entirely at their own risk. The Portal
Subsidiary is not responsible for the content
of any third party Web Sites linked to its Web
Sites and does not make any representations or
warranties regarding the contents or accuracy
of materials on such third-party Web Sites. Further
any material or details posted in the Portal Subsidiary’s
Web Site by any user may be viewed by users of
other web sites linked to the Portal Subsidiary's
Web Site and the Portal Subsidiary will not be
responsible for any improper use by any user or
third party from linked third party web sites
of any data or materials posted on the Portal
Subsidiary's Web Sites.
Indemnity
All
users agree to indemnify, and hold harmless the
Portal Subsidiary, its officers, directors, employees
and agents from and against any claims, actions,
demands, losses or damages arising from or resulting
from their use of the Portal Subsidiary's Web
Sites or their breach of the terms of this Agreement.
The Portal Subsidiary shall provide prompt notice
of any such claim, suit or proceeding to the relevant
user.
Limitation
of Liability
Without
prejudice to the above, the aggregate liability
by the Portal Subsidiary to any user for all claims
arising from their use of the Portal Subsidiary's
services and the Portal Subsidiary's Web Site
shall be limited to the amount of the existing
package fee subscribed to and paid for by the
user (if any) and operative at that time.
IN
NO EVENT SHALL THE PORTAL SUBSIDIARY, OR ANY THIRD
PARTIES MENTIONED ON THE WEB SITE BE LIABLE FOR
ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION,
INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS,
OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS
INTERRUPTION) RESULTING FROM THE USE OR INABILITY
TO USE THE WEB SITE AND THE MATERIAL, WHETHER
BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER
LEGAL THEORY, AND WHETHER OR NOT WWW.MANPOWER-PHILIPPINES.COM.PH
IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Governing
Law and Jurisdiction
This
Agreement and any dispute or matter arising from
or incidental to your use of the Portal Subsidiary's
Web Sites shall be governed by the laws of the
Republic of the Philippines and both you and the
Portal Subsidiary submit to the Jurisdiction of
the courts of the Republic of the Philippines.
